Commonwealth Court Revises How Impairment Rating Exams Impact Benefits
In Diehl v. W.C.A.B. (IA Construction), the Commonwealth Court has ruled that employers that do not request an impairment rating exam in a timely manner under the Pennsylvania Workers' Compensation Act must perform a work availability analysis under the Kachinski standards or conduct a Labor Market Survey. This decision will impact numerous injured workers who have been out of work for more than two years -- and each of these claimants whould seek counsel to be sure that they are fully protected. Workers' Compensation: Employers cannot deny payment for medical care with a new physician.
In Schenck v. W.C.A.B. (Ford Electronics), the Commonwealth Court finally put an end to the practice of many workers' compensation carriers, which have refused to pay for medical care when the carriers had not sought utilization review of the care. In Schenck, the insurance company had obtained a utilization review stating that certain care the injured worker received was unnecessary. When the claimant received similar care from a different provider, the insurance company refused to pay. The Commonwealth Court put its foot down and ruled that an employer/workers' compensation carrier may not deny payment for medical care based upon a prior utilization review determination for similar treatment from a different provider. The Pennsylvania Supreme Court has recently issued a few decisions that impact every person who has auto insurance.
